Musik von Smartsound ist nicht unbedingt Gema frei!!!

Na, da ahne ich schon, wie's ausgehen wird: die GEMA wird gewinnen, und wir alle, die wir uns SmartSound für viel Geld und im Glauben an die allumfassende Gebührenfreiheit dereinst zugelegt haben, werden den Stinkefinger zu sehen bekommen. Und es wird kein Entkommen geben.

Die Deutschen haben wohl nicht genug von den Programmen gekauft und Smartsound schiebt jetzt die Gema vor um wenigstens eine anständige Rente aus Deutschland zu beziehen.
Steckt ja irgendwie in dem Namen schon drin.....

Sehe ich nicht so. SmartSound kassiert ja nicht dabei, wenn dieser Rechtsstreit durchgeht, sondern die GEMA. Im Gegenteil: für SmartSound wird, wenn es so weit kommt, der deutsche (und schweizerische und österreichische?) Markt "out of business" sein

Irgendwer muß ja die Kohle (oder einen Teil davon) bekommen, die die Gema kassiert.
Entweder hat Smartsound nicht die Urheberrechte - dann haben sie illegal gehandelt, oder Smartsound hat die Urheberrechte - dann kriegen sie auch die Kohle! Wenn die Gema in dem Rechtsstreit siegt, wäre Smartsound sogar Schadenersatzpflichtig!
Ich will hier die Gema nicht als leuchtendes Beispiel hinstellen aber ihren Sinn hat sie schon! Wenn ein Künstler meint daß die Gema seine Rechte besser und billiger als ein Rechtsanwalt vertritt (und das tut sie normalerweise), dann ist das seine freie Entscheidung die man akzeptieren muß. Schließlich leben viele von den Tantiemen - und die allermeisten mehr schlecht als recht!

Folgende Antwort vom SmartSound Support habe ich zu den Problemen mit der Gema erhalten:
All of the SmartSound music can be legally used, and GEMA does not have the right to collect royalties on any of those songs. That has always been the case, and continues to be the case. We had a legal case in Germany for several years trying to clarify everything with GEMA, however they are not easy to work with. Any songs on the list that are listed as "royalty free in Germany" are ones that GEMA has officially recognized as royalty-free. That means that, should you use those songs, GEMA should find those songs registered in their database and know that no money is due for the use of those songs. The other songs are ones that GEMA will not list in their system as royalty-free (usually because they have other songs by the same composer who they do collect royalties for).
That said, I did hear from one customer that they still attempted to bill him for songs they know they shouldn't be billing for. So with GEMA, you just never know what they might do. They seem to bill first and deal with any questions later.
Our position remains the same: GEMA does NOT have the rights to collect royalties on any songs that we sell. I have personally worked with every German customer who has contacted me regarding a bill (for any songs, not just the ones marked 'royalty-free') and I have always been able to have the bill dismissed. Should you ever receive a bill from GEMA, please contact me immediately and I will assist you.
The reason we don't advertise many of our songs as royalty-free in Germany and list them as "not license free" is because we know they aren't on GEMA's list. That doesn't mean you don't have the rights to use the music; it just means that you might be hassled by GEMA if you do. And since we don't want our customers bothered, we have chosen to warn you in advance (now that we know the situation) before purchasing so you are aware of the situation. Also, I can't guarantee that I will be able to get GEMA to drop a bill in the future. Although I've always been successful in the past, they are extremely difficult to deal with and I can't guarantee the same results in the future.
We continue to try to work with GEMA to get all of our songs listed as royalty-free with them, and I hope in the future we will be able to get information from them that will help make this easier for everyone.

Danke für die Info.
Ich benutze ja auch meist SmartSound Musik in meinen Filmen und ich werde dabei bleiben. Ist zwar nicht billig, aber wirklich gut. Allerdings verkaufe ich ja meine Filme nicht. Wer sie gerne haben möchte, kann sie gratis haben.Lieben Gruss
